STOP HATE, CHOOSE FREEDOM

She is amazing, intelligent, creative, innovative. Quite simply, a pioneer in her field.

There is, however, a lot of overlap between the two, particularly as both focus on harm, and neither wants to censor hate speech simply because it is offensive. First of all, nobody has a right necessarily to speak on a particular campus. This argument, unlike those based on harm and offense, has the potential to allow significant limits on pornography and hate speech. Given the specific nature of this essay, I will not delve into the issue of offensive behavior in all its manifestations, and I will limit the discussion to offensive forms of speech. Another is that because government is the servant of the people, it should not be allowed to censor them. We should ask three questions according to Fish: According to Mill, free speech fosters authenticity, genius, creativity, individuality and human flourishing.

Nothing will stop this woman from succeeding. Her commitment to her work and growth is an inspiration. She claims her place in the sun. I always recognize that I am just plain old lazy in comparison. This woman knows how to create the life she wants and how to claim it. A virtual bad ass.

She is so beautiful inside and out. We drank, we ate. A friend of hers joined a while later. We drank, we ate some more. For those who know me well… I am a fan of partaking in all kinds of epicurean delights. Inevitably, as most conversations tend to flow, we all ventured into the realm of the heart. Her friend, newly married, shines with the glow from embracing the future; a future of co-creating life with her partner. Inspiring to be around and a joy to feel.

And civil rights activists were kept off many campuses, because their ideas were certainly hated, certainly seen as dangerous and insulting. And today, there are serious government officials who are saying that Black Lives Matter is a hate group.

College campuses have become a focal point in the free speech debate. On the right of colleges to refuse to allow a controversial speaker due to security costs. First of all, nobody has a right necessarily to speak on a particular campus. Campuses can set viewpoint-neutral time-, place-, and manner-rules to allocate this scarce resource of the opportunity to speak on campus.

Just the way in the city of New York, you can't automatically get a parade permit — it's first-come, first-served. And make no mistake about it, in an ACLU case — I'm proud to say, quite a few years ago — the Supreme Court held that imposing higher security costs on the speaker because the viewpoint is seen to be more controversial and therefore it's more likely to generate protests and therefore security costs — that that is just an indirect way of discriminating against the viewpoint.

And you cannot do that.

That's always been a misconception. People tend not to look at the underlying principle, but instead they look at whose ox is gored in the underlying case. And the reason that we're attacking specific policies of Trump is that those specific policies violate civil liberties principles. We did the same with Barack Obama, with Bill Clinton. The ACLU will issue criticism or praise on an issue-by-issue basis.

Trump, no doubt, as a record number of issues on which he is earning criticism. But I don't think there is a single official about whom we cannot issue at least some praise and some criticism. That to me — they are advocating what I see as a form of child abuse.

What do we do about it? We value free expression but loathe government restrictions on speech. How do we address the undeniable impacts of hate speech while preserving the free flow of ideas required for an effective democracy? Private social-media companies can limit hate speech on their sites.

Activist organizations like the Southern Poverty Law Center could lobby to expand the current federal statute to punish threats aimed at broader racial or religious groups.

Free Speech vs. Hate Speech

On a more personal level, individuals with the privilege to do so can confront the people in their lives who use hate speech. Regardless of the approach, the time to act is now. Just because hate speech is legal, does not make it right. And civility is a choice. Moving forward we can choose not to support individuals and institutions that condone the use of hate speech.
