The Will

Will (philosophy)

I could go on and tell you about Jake being a boxer and Josephine having an amazing taste in clothes and talking in elaborate words. I could describe all these and gash about how much I loved it. I could also say that I understand some fellow reviewer's frustration about the inner-dialogues, the second-guessing, how the heroes somehow behaved like they were in their twenties instead of forties, but it's KA and I don't mind.

Waiting for the book View all 17 comments. The only person Josie could trust and love unconditionally after being hurt in the past, just died. And with the death of her grandmother, Lydia, comes the most extraordinary will Josie could ever imagine. And with that will, comes the even more extraordinaire, Jake Spear. Their past and th 5 Lavender Stars. Their past and their future collides more than Josie realizes, and unfortunately, the only person who could answer all her questions, is playing matchmaking from the other side. This was a slightly different storyline that her usual, with a slower action and slightly older not that much main characters than we were used, but not less beautiful for that.

In fact, I believe this amazingly beautiful story, is probably one of her best books so far. And she has a lot of amazing books. Dual POV but mostly female. Well, look at the author. Do I need to say more about the writing in this book? I loved both of them. Neither of them was perfect, and yet, they were perfect together.

The supportive characters were great, as always, and I especially loved Ethan. That kid was awesome!! I love Kristen Ashley. I don't even care, you naysayers can naysay all you want, and I'll still love her. But that's turning more and more into a cumulative thing. This was like KA as seen through opaque glass: It would seem I breathed too soon.

So what was wrong with it? I understand what KA was trying to do here, I really do, but she wayyyy over-shot. She was trying to create a false kind of hoity toity, high society type, a character who hides behind proper speech and big words. A problem from which one can infer that we know what people talk like in real life. And Josie does not speak like a real, live person. Not a real, live person in the year of our Lord, anyway. She refers to Jake as a "pugilist. And, though I have absolutely no idea how, I actually knew what a pugilist was it's a boxer.

But one of my favorite things about reading on a kindle is having the OED at my fingertips. For anyone who doesn't know, that means that not only can I define words as I'm reading, I can also trace the word origin, which means I know that the word "pugilist" hasn't been used colloquially since the midth century.

She also insists on referring to Jake's children's friends as "young, insert-name-here. It's cute and quirky. Wanna know what's NOT cute and quirky? Not cute and quirky. Lack of villainous villains.

Non-paranormal KA books are mostly romantic suspense. There's always a Bad Guy. A Bad Guy who's bad enough to need to be either killed, or imprisoned. Overall the plot was just MEH. Tough Guy was keeping a Secret from Josie, but the Secret was pretty guessable, and it was one of those Secrets that's not much more than an insight into Tough Guy's psyche, meant to endear him to you. Yes, I judged a book by its cover. The death of Josephine's grandmother, Lydie, has brought her back to the Lavender House. The only house that Josephine has ever felt like it was home to her. At the reading of the will she learns that her grandmother has left her to a man. This unconventional request starts the ball rolling in the love story between a prim and proper, Mary Poppins type , Josephine , and a rough around the edges, Jake.

My man is going to be strong and tall and handsome and smart and protective and fierce, so very FIERCE, and wonderful and he's going to adore me. Josephine has the same problem that Gwen from Mystery Man encountered; a bunch of hot eligible guys wanting to date her. I'm going to predict that the next two books in this series will feature - Amond and Mickey.

And like her Own the Wind series she might do a spin off with Jake's kids. Jake is a parent of teenagers and so am I three highschoolers. Teens can be handful at times and at this stage of child development we as parents are faced with a whole new set of worries: Sometimes just listening to my three teenagers I feel like I'm living in a young adult book. I like the dynamics Jake's children brought to the overall story. The Magdalene Series is a new series starting in It will be a trilogy of romances set in the fictional town of Magdalene, Maine. Classy Josie all prim and proper falling for 'pugilist' Jake and finally finding what she has always wanted, love and family. It was a sweet read, but it really made me miss my grandma -: My girl know this and never forget. It's never too late to reach for happiness and no matter what life has done to you, it's never too late to find it Please Josie, take Jake's hand and let him guide you to happiness. Written May 20, If it's possible this one is just that. An adorable, charming, heartwarming romance novel. A story about everything and nothing. A very long book and even longer audiobook - freaking It's always with some angst I start a new book by Kristen Ashley — Will it be a winner or not?. I got this Written May 20, Josephine Malone , a 45 years old woman trotting the globe as an assistant to a famous fashion photographer.

When her very beloved grandma Lydia pass away Josie is back in her grandma's beautiful old big Magdalene, Main house. Already at the funeral is Josie watching a stunning goodlooking man. He is there with his three children two teens and a younger boy and later it turns out that Josie's grandmother felt very much for this man and his three children. Grandma Lydia's will has a quite remarkable gift, or perhaps a kind of future hope for a woman and a man which yet has to find the "perfect right one". She had a wish about a perfect match. Gosh, Ms Ashley for sure know how to "wake up" a slumbering lady.

Hot, hard and sooo d mn sweet. Ashley is awesome, but sometimes she gets tedious. Finally are there pretty much text and story about nothing, and my patience is long but not infinite. And this time, having had him, having given him me, that touch was even sweeter. I've spent so much time with these adorable characters and it's time to move on.

You all knew I loved it by now. I LIKE - sweet tales with mature grownups, interesting families and funny friends View all 42 comments. This woman does not snack. She doesn't enjoy sport. She doesn't like kids. She's never walked holding a man's hand. She's never had a home she lived in her boss's pool house. She's a cold fish. It's a disguise, preventing people from getting close and hurting her. I think she's not meant to be likable and the intended appeal is the softening heart of the fashion diva, like Wilhemena in Ugly Betty or Meryl Streep in The Devil Wears Prada.

Her cluelessness and lack of life experience are meant to show her vulnerability. And your supposed to feel compassion for this fish out of water, lost, lonely girl. Suffice it to say, I just did not buy it. I did not feel the magic. I want some Amond Joy dark chocolate yummy love. I liked Jake's pov, I liked the pillow talk and the sex. But, I was turned off by Jake's three failed marriages, and the titty bar, regardless if it's "respectable". I would have liked to see Josie helping them get real jobs instead of straightening their hair.

Or even a modeling gig? The intention here was that Jake is redeemed depite his shaky past, a sort of anti-hero theme. Similar to Knight, which I also didn't care for. Jake is supposedly insecure of his worthiness of this chick, but his thoughts and actions are not consistent with that. So both characters present this sort of ironic situation, that just didn't resonate with me.

A damaged Mary Poppins is rescued from her self imposed isolation by this insecure titty bar owner with a bad track record. It's supposed to be polar opposites conquer all despite their circumstances, but the juxtaposition was too much here for me to believe it. I also really disliked that the whole boxing arena knew about the locker room and cheered. I didn't like her meddling in teen drama and her lying. I didn't like the children being abandoned by their real mothers and substituting Josie.

I totally gave up when she kissed another guy, and Jake didn't go ballistic. I may return to this when I'm in a less sour mood. But today ain't the day I'm gonna finish this behemoth. I did change my mind on a second read of Golden Trail , which was very similar to this. I personally like the new concise streamlined KA style, and do not need all the details from this chick's brain.

I would not rec this to KA virgins. Start with The Gamble, but Not This. I still absolutely adore and respect KA's mad genius, this one I just didn't buy in. And that is lavender on the cover. I thought it was lupine, but I was wrong. They have been photoshopped, but they are lavender. View all 51 comments. I'm way to emotional right now to write a full review. All I can say through all my sniffling and tears is that this book was beyond amazing and it touched the very depths of my soul.

This is one of the sweetest, heartfelt stories I've ever read. Now if I can only stop crying View all 31 comments. I have to say The Will is going to be added to that list. It was like someone took hold of my hand and patiently guided me through the story of Josephine Josie Malone and Jake Sp 5 Lovely Stars In true Kristen Ashley fashion she gave us such a beautiful story of family, friends and love.

It was like someone took hold of my hand and patiently guided me through the story of Josephine Josie Malone and Jake Spear. To be truthful though, I read bits and pieces of some reviews just to appease my curiosity about a couple of things but that was about it. Josie was stunningly beautiful, spoke very graciously, and had a kind soul.

Things that happened to Josie in the past has snuffed out her inner light. She led a good life though. She worked in high fashion, jetted off to beautiful countries and had all that material things she could want. Jake was warmhearted, caring and compassionate. He lived his life loving and providing for his three children. But when it came to matters of the heart Jake fell a bit short. They were all navigating through the things that were being thrown their way. And I loved all the little things that happened in this book too. The funny moments at the dinner table or while watching TV, the forehead kisses Jake would give Josie, the girl conversations between Josie and Alyssa a good friend and Ethan thinking Jake and Josie kissing all the time was gross.

So if you have read books by Kristen Ashley before I know you will love this one too. If you enjoy books about family, friends and a good love story, then you will truly enjoy this one! And she got that by having Jake. View all 55 comments. March 8, Facebook Update Happy Saturday!

Jan 08, Rachel Reads Ravenously rated it really liked it Shelves: When I saw that pretty much all of my Goodreads friends were unanimous in loving this book 4 stars!

When I saw that pretty much all of my Goodreads friends were unanimous in loving this book, I decided to jump back in with this one. The story begins with Josie at the funeral of her beloved grandmother. Josie hasn't been back to Magdalene in years, as she was trotting the globe as an assistant to a famous photographer. Losing her Gran meant she had lost what was left of her family. The former boxer and town strip club owner.

Wills, probate and inheritance

At first Josie is horrified, by the idea and by Jake's profession, but over time and by getting to know him, Josie discovers there is more to Jake than meets the eye. I was worried I wouldn't be interested in their romance or lives, but then I remembered how amazing Ashley's Sweet Dreams was, also about a couple in their forties, and decided to give this a chance. While this book does focus on issues that people in their forties face, like former lovers, ex wives, children and more, I still thoroughly enjoyed this book because it held strong themes of family, love, survival, and finding one's place in life when things change abruptly.

I loved the slow building romance between Josie and Jake, along with the little misunderstandings Josie had about Jake's interest. Josie's relationship with Jake's children was beautiful; she helped them without ever forcing her way in or being overbearing. She didn't try to be cool or someone different for their sakes, instead she was herself and showed constantly how much she cared about them and their well being.

The side plot with Henry made me kind of sad, I really hope he gets his own book or at least a mention of an HEA. I know he's the one who fucked things up with Josie, but come on. Men tend to not think things through all of the time. A lot of the time. One was the side plot about Conner and his five high school girlfriends. It didn't really make sense to me that Kristen Ashley would develop Ellie just to have them break up, with Conner being less than understanding of Ellie's position her parents put her in, just to find another different girlfriend by the end.

I would rather have had Ellie not exist and use Sophie instead. It just seemed like a waste of plot to me, but I guess I'm just being nit-picky. It drove me up the wall! She sounded like a pretentious snob and everyone was like, "oh you talk weird, that's cute". I'm over here like, "um, no. She sounds incredibly rude and condescending" but whatever. Despite the way she talked, I still really liked Josie mostly because she had a heart of gold and when you were someone she cared about, she took care of you.

This book really did feel like one of Kristen Ashley's older works, and was a great romance that was well developed and not cheesy, which worked perfectly for me. That friggin epilogue had me crying giant ugly tears. Right in the damn feels. First, I hate crying.

Especially if it's over a book. I get all red nosed, blotchy faced, red eyed demon looking. After I cry, I can't speak. My throat gets tight. It feels like there is a ball in my throat get your mind outta the gutter and I have to swallow hard again, get your mind outta the gutter repeatedly to talk and then when I do it goes something like this I I I r r rre rreal rrreally lllloooove this booooook! S First, I hate crying. Now, why did I mention that?

Kit's epilogues are some of THE best out there. Third, it doesn't always mean that someone dies in a story. It can be a moment, a phrase or just how well a story is told that I just GET it. On to the story Fate comes in many different shapes and forms. In this case in comes in The Will. They are both taken surprised to this. Josie and Jake are from two completely different worlds. You would think they wouldn't have anything in common but they do. When I read Josephine, I found her language on the nanny side being very proper. It kinda thru me off but I got over it and I'm pretty sure you will too.

It teaches you to expand your vocabulary. It's about family too and this family is one of the best I've read. The way Jake is with his kids is funny, adorable, laughable and men could learn a lesson or two.

Of course there are side characters that are just as yummy and funny and you know that they'll get a story so I won't delve into them. In this story little by little, words by words, touch by touch it's revealed how even when someone is physically gone their presence is always felt with what special gift they left behind which is the power of love. Sometimes there are just no words that I can write down to do any justice to Kristen Ashley's books. I've been saying this for years but if you haven't read anything by her Women have their own power.

I will simply try to tell you how it felt for me and what you can expect to find in it, leaving to you the privilege of meeting Josephine and Jake in The Will. She has her unique way to draw you in a world for you to wish it existed. I asked myself out loud "where have you been all this time? I wanted to stay in her world and never coming back to reality.

This was only a year ago and by now I have read all her books. For the devolution of property not disposed of by will, see inheritance and intestacy. Though it has at times been thought that a "will" was historically limited to real property while "testament" applies only to dispositions of personal property thus giving rise to the popular title of the document as "Last Will and Testament" , the historical records show that the terms have been used interchangeably.

A will may also create a testamentary trust that is effective only after the death of the testator. Throughout most of the world, disposal of an estate has been a matter of social custom. According to Plutarch , the written will was invented by Solon. Originally, it was a device intended solely for men who died without an heir.

The English phrase "will and testament" is derived from a period in English law when Old English and Law French were used side by side for maximum clarity.

Other such legal doublets include " breaking and entering " and "peace and quiet". The conception of the freedom of disposition by will, familiar as it is in modern England and the United States, both generally considered common law systems, is by no means universal. In fact, complete freedom is the exception rather than the rule. Civil law systems often put some restrictions on the possibilities of disposal; see for example " Forced heirship ".

Advocates for gays and lesbians have pointed to the inheritance rights of spouses as desirable for same-sex couples as well, through same-sex marriage or civil unions. Opponents of such advocacy rebut this claim by pointing to the ability of same-sex couples to disperse their assets by will. Historically, however, it was observed that "[e]ven if a same-sex partner executes a will, there is risk that the survivor will face prejudice in court when disgruntled heirs challenge the will", [3] with courts being more willing to strike down wills leaving property to a same-sex partner on such grounds as incapacity or undue influence.

Some jurisdictions recognize a holographic will , made out entirely in the testator's own hand, or in some modern formulations, with material provisions in the testator's hand. The distinctive feature of a holographic will is less that it is handwritten by the testator, and often that it need not be witnessed.

In Louisiana this type of testament is called an Olographic or Mystic will. Although the date may appear anywhere in the testament, the testator must sign the testament at the end of the testament. Any additions or corrections must also be entirely hand written to have effect.

In England, the formalities of wills are relaxed for soldiers who express their wishes on active service; any such will is known as a serviceman's will. A minority of jurisdictions even recognize the validity of nuncupative wills oral wills , particularly for military personnel or merchant sailors. However, there are often constraints on the disposition of property if such an oral will is used. Any person over the age of majority and having " testamentary capacity " i.

Additional requirements may vary, depending on the jurisdiction, but generally include the following requirements:. There is no legal requirement that a will be drawn up by a lawyer, although there are pitfalls into which home-made wills can fall. The person who makes a will is not available to explain him or herself, or to correct any technical deficiency or error in expression, when it comes into effect on that person's death, and so there is little room for mistake.

A common error, for example, in the execution of home-made wills in England is to use a beneficiary typically a spouse or other close family members as a witness—which may have the effect in law of disinheriting the witness regardless of the provisions of the will. A will may not include a requirement that an heir commit an illegal, immoral, or other act against public policy as a condition of receipt. In community property jurisdictions, a will cannot be used to disinherit a surviving spouse, who is entitled to at least a portion of the testator's estate.

In the United States, children may be disinherited by a parent's will, except in Louisiana, where a minimum share is guaranteed to surviving children except in specifically enumerated circumstances [7]. Many civil law countries follow a similar rule. In England and Wales from to , a will could disinherit a spouse; however, since the Inheritance Provision for Family and Dependants Act such an attempt can be defeated by a court order if it leaves the surviving spouse or other entitled dependent without "reasonable financial provision".

The Convention provided for a universally recognised code of rules under which a will made anywhere, by any person of any nationality, would be valid and enforceable in every country which became a party to the Convention. These are known as "international wills". Although the US has not ratified on behalf of any state, the Uniform law has been enacted in 23 states and the District of Columbia.

For individuals who own assets in multiple countries and at least one of those countries are not a part of the Convention, it may be appropriate for the person to have multiple wills, one for each country. Intentional physical destruction of a will by the testator will revoke it, through deliberately burning or tearing the physical document itself, or by striking out the signature. In most jurisdictions, partial revocation is allowed if only part of the text or a particular provision is crossed out. Other jurisdictions will either ignore the attempt or hold that the entire will was actually revoked.

A testator may also be able to revoke by the physical act of another as would be necessary if he or she is physically incapacitated , if this is done in their presence and in the presence of witnesses. Some jurisdictions may presume that a will has been destroyed if it had been last seen in the possession of the testator but is found mutilated or cannot be found after their death. A will may also be revoked by the execution of a new will.

There is some controversy over whether banks may seal a safe-deposit box after a renter's death, so consult a professional regarding storage of this important document. If one does not have a will before death, the state's intestate succession rules determine how a person's assets are distributed. These rules vary by state. Normally, a person's spouse and children receive the estate first, then members of extended family.

If there are no surviving family members, the estate may pass to the state. A will is central to a person's estate planning.

Will, generally, is that faculty of the mind which selects, at the moment of decision, the strongest desire from among the various desires present. Will does not. A will or testament is a legal document by which a person, the testator, expresses their wishes as to how their property is to be distributed at death, and names.

In most cases, people create wills to protect the assets they have worked hard for and to ensure they are passed to appropriate individuals or organizations. However, court procedures, called probate, are often required to legally pass assets from a testator to beneficiaries because the testator is no longer around to sign deeds and other documents necessary to actually transfer the assets. In probate, a judge must validate the will and then issue a court order to distribute the assets.

Everything in a will becomes public record after it is probated. In general, the testator transfers his or her assets to a trust while alive, and the trust -- which is usually controlled by the testator -- in turn designates the beneficiaries. This often avoids the need for probate and can also reduce estate taxes in certain circumstances. There are many kinds of trusts and trust structures, and a professional estate planner should be consulted when considering this option.

It is important to keep a will up-to-date because life events, such as marriages, divorces, deaths, separations, moving, significant changes in assets or the birth of a child often change a testator's needs or wishes. It is also important to note that titles to assets joint tenancy , joint tenancy with right of survivorship, etc.

Estate planning is a complex subject, and it is of particular importance to consult an estate-planning specialist when considering how to distribute assets after death. See the full definition for will in the English Language Learners Dictionary. A properly executed international will is still subject to local probate laws; the validity deriving from adherence to statutory requirements for such wills is purely formal, and a will invalid in respect to such requirements may still be valid under other rules. A joint and mutual will is a joint will, but a joint will need not contain reciprocal provisions.

Pruss , N. The Louisiana Civil Code requires that for a mystic will to be valid, the will document itself or the envelope containing it must be closed and sealed and thus presented to the notary public and witnesses, or closed and sealed in their presence, and the testator must declare that it contains his or her signed will. The envelope or closed document must be subscribed by the testator, witnesses, and notary public.
